If I have an accident on my way to work, am I covered by workers’ compensation insurance?
Yes, in Portugal, it is usually covered by work accident insurance if you have an accident on your way to or from work. This is called an “in itinere” accident.
The coverage is provided for in Law No. 98/2009, which regulates work accidents.
When it is considered a work accident on the way to or from work, the insurance usually covers accidents that happen:
On the direct route between home and the workplace
Between work and the place where you have lunch, if it is usual
Between two workplaces, if you have more than one
Between work and a place where you receive medical assistance because of a previous accident.
It is necessary that, to be considered a work accident, the route must be the normal or usual route, without unjustified deviations, and without prolonged interruptions for personal reasons.
Small justified deviations (for example, dropping a child off at school or avoiding traffic) may be accepted, depending on the case.
